In the name of God Amen. I James Smoot of Rowan County being of Sound
and perfect mind and memory Blessed be god do this 8th day of October in
the Year of our Lord 1836 Make and publish this my last will and Testament
in Manner following that is to say.
   First give my soul to god who gave it. I wish to be Buried in a christian
like manner at the Expense of my Estate.
   I give and Bequeath to my Beloved daughter Mary Gaither one Negroe boy
named Caleb Being her full Share.
   I Give and Bequeath to my Grand daughter Elizabeth Gaither one hundred
and thirty seven dollars and fifty cents, one feather Bed and Furniture
being her full part.
   I give to my daughter Margaret Anderson Two Hundred dollars in Cash.
   I Give to my daughter Hennaritta Lion Two hundred dollars in Cash.
   I Give to my daughter Brittana Sloan Two hundred dollars in Cash.
   I give to my Son Thomas B. Smoot Two hundred dollars in Cash.
   I Give to the Heirs of my daughter Elizabeth Gaither decd The sum of
Two hundred Dollars in Cash to be Equally divided among them Except Elizabeth
who is before named.
   I give to the Hiers of my daughter Elinder Anderson decd the sum of 
Two hundred dollars Cash to be Equally divided among them.
   All the remaining Estate to be divided into six parts among the before
named Hiers as above stated and I hereby make and ordain my worthy friend
Gassaway Gaither Executor of this my last will and Testament in witness
whereof I the said James Smoot have to this my last will and Testament
set my hand and seal the date before written.  Signed Sealed and Acknowledged
in the presence of us who were present at the time of signing and sealing thereof.
