In the Name of God Amen This twenty Eighth day of September Eighteen Hundred
and Eight, I John Higgins of the county of Montgomery and state of Maryland being
in my right mind and memory thanks be to God for the same and calling to mind the
mortallity of my body and knowing that it is apponited for all men to die do make
and ordain this my last Will and Testament that is to say, Principally I give and
recommend my Soul to God that gave it and my body I recommend to Earth to be
buried in a decent manner at the descretion of my Executors herein after mentioned
nothing doubting but at the general resurrection I shall receive the same by the mighty
power of God, as touching such Worldly Estate where as it has pleased God to bless
me with in this life I give and dispose of in the following manner (Viz).
I give and bequeath to my beloved wife Jamima Higgins all my property after my
Just debts are paid to her during her natural life but if she should marry again, It shall
then go to my beloved daughter Rachel Tucker and her heirs and to my son William
Higgins and his Heirs to be equally devided between them and their Heirs, It is my
desire that my three negro Children Rezin, Cenet and Nathan shall be free at the
following ages, Rezin and Nathan at the age of thirty one years and Cenett at the age
of Twenty five years. It is my request that my dear wife Jamima Higgins and Richard
Tucker to be my Executor and Executrix of this my last Will and Testament and do
utterly disallow revoke and disannull all and every other former Will and Testament
ratifying and confirming this to be my last Will and Testament and no other In witness
here of I have here unto set my hand and Seal this day and year above

On the 10th day of November 1808 Then came Dennis Lackland and Robert D.
Dawson two of the subscribing Witnesses to the within last Will and Testament of
John Higgins late of said County deceased and severally made oath on the holy
Evangels of Almighty Got that they did see the Testator here in named sign an[d]
seal this Will and that they heard him publish pronounce and declare the same to be
his last will and Testament that at the time of his so doing he was to the best of
their apprehensions of sound and disposing mind memory and understanding and
that they respectively subscribed their names to this Will as Witnesses in the presence
and at the request of the Testator and in the presence of each other and also in the
presence of Margarett Moreland the other subscribing witness here to.
